שיטת המס הבינלאומי על-פי פקודת מס הכנסה הישראלית - דורון, טיקוצקי, עמיר, מזרחי עורכי דין ונוטריון

מכיוון שתפקידו העיקרי של המס הוא לממן את פעולותיה של הממשלה, אחת השאלות אותה כל ממשלה בכל רחבי הגלובוס שואלת את עצמה, היא על מי להטיל את המס? קו פרשת המים בישראל במענה לשאלה זו 'שורטט' על ידי הממשלה ביום 1.1.2003, המועד בו נכנס לתוקפו החוק לתיקון פקודת מס הכנסה (מס' 132), התשס''ב- 2002 (להלן: ''החוק לתיקון פקודת מס הכנסה'').
תחולתו העיקרית של החוק לתיקון פקודת מס הכנסה הינה על הכנסה שהופקה או נצמחה החל משנת המס 2003 ואילך (להלן: ''הרפורמה''/ ''רפורמת המס''). עיקר הרפורמה התמצה במעבר משיטת מס הממסה תושב ישראל (יחיד או חברה) על בסיס טריטוריאלי, קרי מיסוי כל ההכנסות שהופקו או נצמחו בישראל בלבד, לשיטת מס על בסיס פרסונלי, קרי מיסוי כל ההכנסות של תושב ללא תלות בזהות מקום הפקת ההכנסה. התוצאה של שינוי שיטת המס והמעבר למיסוי על בסיס פרסונלי פרושה הרחבה, הלכה למעשה, של בסיס המס בישראל.
לעניין מי שאינו תושב ישראל נותרה על קנה שיטת המס הממסה על בסיס טריטוריאלי, והוא מחויב במס אך בגין ההכנסות שהופקו או נצמחו בישראל בלבד.
כיצד שונה משטר המס לגבי הכנסה פירותית? סעיף 2 לפקודת מס הכנסה(נוסח חדש), התשכ''א-1961 (להלן: ''הפקודה'') קובע כי מס הכנסה ישתלם על ''הכנסתו של אדם תושב ישראל שהופקה או שנצמחה בישראל או מחוץ לישראל'' (מיסוי על בסיס פרסונלי) ועל ''הכנסתו של אדם תושב חוץ שהופקה או שנצמחה בישראל'' (מיסוי על בסיס טריטוריאלי), מהמקורות הבאים: עסק ומשלח יד; עבודה; דיבידנד, ריבית והפרשי הצמדה; גמלאות; דמי שכירות, תמלוגים, דמי מפתח, פרמיות ורווחים אחרים שמקורם במקרקעין; השתכרות או רווח מנכסים שאינם מקרקעין; חקלאות; פטנט וזכויות יוצרים; והשתכרות או רווח מכל מקור אחר.
כיצד שונה משטר המס לגבי רווח הון? לפי סעיף 89 לפקודה, הרי ש- ''תושב ישראל חייב במס על רווח הון שנצמח או שהופק בישראל או מחוץ לישראל'' (מיסוי על בסיס פרסונלי) ו- ''תושב חוץ חייב במס על רווח הון שנצמח או שהופק בישראל'' (מיסוי על בסיס טריטוריאלי).

במאמר קודם מטעם משרדנו ענינו לשאלה החשובה מיהו תושב ישראל לצורכי מס על פי הפקודה. נוכח האמור מעלה, כי כל תושב ישראל באשר הוא, חייב במס על הכנסותיו בישראל ללא תלות במקום הפקת או צמיחת ההכנסה, התשובה לשאלה מיהו תושב ישראל לצורכי מס הינה שאלה מכרעת ביותר.
לסיום נציין, כי הרפורמה לא החלה והסתיימה אך ורק לגבי שינוי בסיס המס בישראל, אלא שגם סעיפים רבים שונו בפקודה, לרבות חובות דיווח החלות על תושב ישראל על פי פקודת מס הכנסה.
